Benner, Davis Arrested On Burglary Charges, Stolen Items Recovered From Beginning of March

(Jefferson County, Ind.) - On Monday, March 30, Jefferson County Sheriff’s Deputies were dispatched to the 1000 block of North US 421 just north of downtown Madison on the report of suspicious activity a residence that is currently vacant.

Upon arrival, Jefferson County Deputies located James Leroy Davis, 41, Elmer Emroy “Roy” Benner, 53, both of Milton along with Teri J. Johnson, and a juvenile female on the property without permission of the owner of the property.

During the encounter, Benner attempted to flee the scene.

After completing the on-scene investigation, Benner and Davis were transported to the Jefferson County Jail.

The sheriff’s deputies continued the investigation where they then learned that Benner and Davis were potentially involved in other reported burglaries at this location during the month of March.

On March 31, Trimble County (KY) Sheriff’s Deputies assisted the Jefferson County Deputies with obtaining and executing a search warrant at a resident on School Hollow Rd. in Milton.

During the search of the residence, deputies found numerous items that had been reported stolen from the residence in Indiana.

This investigation is currently active and under investigation by the Jefferson County Sheriff’s Office. Benner and Davis will make their initial appearance in Jefferson County Superior Court later this week.

The charges for the two men are as follows:

James Leroy Davis was charged with Burglary (Level 5 Felony), Conspiracy to Commit Burglary (Level 5 Felony), Possession of Methamphetamine (Level 5 Felony).

Elmer “Roy” Benner was charged with Burglary (Level 5 Felony), Conspiracy to Commit Burglary (Level 5 Felony), Resisting Law Enforcement by fleeing (A-Misdemeanor).
