Unlawful mailing or delivery of abortion pills into Kentucky

Kentucky Attorney General Russell Coleman has announced a civil investigation today into organizations that could be participating in the unlawful mailing or delivery of abortion pills into Kentucky. The Attorney General’s Office sent subpoenas to six gas stations in Christian, Logan and Simpson counties that featured advertisements for abortion pills.
The subpoenas seek information from the gas stations regarding advertisements that read “Pregnant? Don’t want to be? Learn more at Mayday Health.” The gas stations have 20 days to respond to the Attorney General’s Office or face potential legal action to force compliance with the subpoenas.
In 2022, the General Assembly passed House Bill 3 (HB 3), which prohibits the mailing or delivery of abortion-inducing drugs in Kentucky. In addition, Kentucky’s Consumer Protection Act prohibits deceptive or misleading communications with Kentuckians. The Attorney General’s investigation seeks to determine whether the companies behind these advertisements violated Kentucky law. According to media reports, Mayday Health paid to run these ads at 104 rural gas stations in multiple states.
Any Kentuckian who sees one of these advertisements or suspects any other unlawful business activity is encouraged to report it to the Attorney General’s Office of Consumer Protection here.
“Out of state activist groups who are targeting the vulnerable here should be on notice: Keep your illegal pills out of our Commonwealth or face the full weight of the Attorney General’s Office,” said Attorney General Coleman. “These deadly and unlawful pills cannot be allowed to continue flooding into Kentucky through the mail, and we will thoroughly pursue every lead to hold bad actors accountable.”
