Switzerland Co Man Charged in Fatal Accident

Fatal crash that occurred on August 24th, 2021

                                  

Charges were filed on December 16th, 2021 against Alexander Scott Lynn, of Vevay Indiana. These charges stemmed from a fatal crash that occurred on August 24th, 2021 on Salem Ridge Road near Poor House Hill Road, in Ohio County. Alexander Lynn has been charged with Operating While Intoxicated Causing Death, a Level 4 Felony, Operating While Intoxicated Causing Serious Bodily Injury, a Level 5 Felony, and other related charges.

The investigation began a little after 8 a.m. on August 24th when a passenger car driven by Alexander Lynn struck an off-road vehicle (Polaris Ranger). The crash resulted in the death of Brandon J. Foutty, age 34 and serious bodily injury to Leo Philpot, age 63. Alexander Lynn was not injured.

On scene, officers determined that a silver, 2018 Chevrolet Malibu, driven by Alexander Lynn was westbound on Salem Ridge Road approaching a westbound 2018 Polaris Ranger off-road vehicle being driven by Leo Philpot with Brandon Foutty sitting in the front, passenger seat. Alexander Lynn attempted to pass the Polaris on a double yellow line at the same time the Polaris was trying to turn left into a field. The occupants of the Polaris were going to cut brush and prepare hunting sites for the upcoming hunting season. The Malibu struck the Polaris, causing the Polaris to rollover onto its passenger side, where Brandon Foutty was trapped. Both Leo Philpot and Brandon Foutty were transported to St. Elizabeth Dearborn Hospital. Brandon Foutty’s injuries were fatal and Leo Philpot sustained serious bodily injury.

Alexander Lynn stated he was in Michigan the day prior and smoked marijuana. He also went on to state that when this event occurred, he was on his way home from working the night shift at the Amazon Distribution Center located in Hebron Kentucky. The Officer who transported Alexander Lynn to the hospital, stated the odor of marijuana was coming from Alexander Lynn. The Indiana Department of Toxicology tested the blood, and it demonstrated the presence of a controlled substance, THC, in Alexander Lynn’s system. Leo Philpot, the driver of the Polaris, did not have a controlled substance in his blood and alcohol was not a factor.

The Indiana State Police investigated and prepared the charges, the Ohio County Sheriff’s Department and Aurora Police assisted in the investigation. Alexander Lynn surrendered himself on the warrant and received his Initial Hearing before Magistrate Kimberly Schmaltz.

Regarding the case, Prosecutor Deddens said, “I am saddened by the loss of life and serious injury in this case. I commend the officers involved for their good work, and my office will vigorously pursue justice as we move forward with this case.”

All charged filed in this case are merely allegations and the Defendant is considered innocent unless or until proven guilty in a court
