(Lawrenceburg, Ind.) - A Dearborn County jury has convicted Daniel Birdseye on numerous charges.
The four-day trial concluded on Thursday night with the jury finding Birdseye guilty of Kidnapping (Level 3 Felony), Criminal Confinement with a Deadly Weapon (Level 3 Felony), and three counts of Intimidation with a Deadly Weapon (Level 5 felonies).
This is believed to be the first prosecuted casino robbery in Indiana.
Birdseye, 42, of Cincinnati, also pleaded guilty on the first day of trial to Robbery with a Deadly Weapon (Level 3 Felony).
The jury acquitted Birdseye on one count of Criminal Confinement and one count of Intimidation.
According to a probable cause affidavit, Birdseye allegedly pulled out a 9 mm handgun on a Hollywood Casino employee and demanded money from the casino cage area.
After taking cash from the main bank, investigators say Birdseye then went to a few cashiers' windows demanding money from them.
One casino employee said she was on the phone and Birdseye said to her, "Hang the phone up ***** or l will shoot you."
Birdseye was taken into custody shortly after the incident in the nearby Oxbow area.
"The jurors devoted significant time and attention to this case and were asked to carefully consider extensive evidence, surveillance footage, and witness testimony," said Prosecutor Lynn Deddens. "The jury's attention to detail and commitment to reaching a fair verdict after hearing extensive testimony and evidence is sincerely appreciated."
Sentencing is set for August 4 at 10:15 a.m. before Honorable F. Aaron Negangard.
